Outdoor Fire Pits, Fireplaces

and Chimineas

These devices have gained in popularity over the past several years, and they come in many shapes and sizes. As with barbeques these devices must be used in a safe manner with the following guidelines:

  • They shall not be used within (10) ten feet of any building or structure at any time.
  • There shall be NO OVERHEAD obstructions of any kind while in operation. (Obstructions shall include, but are not limited to: roofs, ceilings, decks, porches, overhangs, tree branches, clothesline, tents, etc.)
  • They shall not be placed on porches, roofs, nor balconies, or near any flammable or combustible material.
  • They shall be attended at all times while in operation.

These devices must be fueled by clean firewood and the burning of trash, refuse or other similar material in such devices is prohibited. 310 CMR 7.09 prohibits any burning which creates a nuisance or a condition of air pollution (i.e., excessive smoke) or hazard to others, and again the fire department does have authority to enforce this prohibition.
